You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate, current, and complete information for registration, billing, pickup, cargo description, destination, consignee, customs documents, and delivery instructions.
4. Shipment Requirements
You are responsible for properly describing, packaging, labeling, and documenting shipments unless we agree otherwise in writing.
- You must not ship prohibited, illegal, counterfeit, stolen, unsafe, or restricted goods.
- You must disclose fragile, hazardous, temperature-sensitive, high-value, regulated, or unusual cargo before booking.
- You must provide accurate weight, dimensions, value, contents, origin, destination, and consignee information.
- You are responsible for duties, taxes, customs fees, storage charges, penalties, return costs, and other charges caused by inaccurate or incomplete shipment information.
5. Prohibited & Restricted Items
Prohibited or restricted items may include weapons, explosives, illegal drugs, counterfeit goods, stolen goods, live animals, hazardous materials, cash, certain valuables, controlled substances, and items restricted by law, carrier rules, destination rules, or customs authorities. We may refuse, suspend, return, dispose of, or report shipments that appear unsafe, unlawful, restricted, or improperly documented.
6. Quotes, Pricing & Payment
Quotes are based on the information available when provided and may change if shipment details, carrier rates, duties, taxes, fuel surcharges, storage charges, route availability, delivery requirements, or service conditions change. Payment is due according to the invoice or checkout terms. We may hold, delay, or refuse service for unpaid balances, suspected fraud, or incomplete payment information.
7. Delivery Estimates & Tracking
Delivery dates, transit times, and tracking updates are estimates unless expressly stated as guaranteed in writing. Delays may occur because of weather, customs review, inspections, traffic, labor disruptions, carrier issues, incomplete documents, incorrect addresses, security checks, force majeure events, or other conditions outside our control.
8. Cancellations, Returns & Service Changes
Cancellation, return, rerouting, address correction, storage, or service change requests may be subject to carrier acceptance and additional fees. Some charges may be non-refundable once a shipment is booked, dispatched, processed, stored, inspected, or transferred to a partner.
9. Insurance, Loss & Damage
Shipping involves risk. Optional cargo insurance or declared value coverage may be available for eligible shipments and may require additional fees, accurate cargo value, and supporting documents. Unless required by law or agreed in writing, liability for loss, damage, delay, misdelivery, or nondelivery may be limited by carrier rules, shipment documents, service agreements, applicable conventions, or law.
10. Limitation of Liability
To the fullest extent permitted by law, Yempa Cargo is not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost business, loss of use, or reputational harm. Our total liability for a shipment or service issue will not exceed the amount permitted by applicable law, carrier terms, shipment documents, or the amount paid for the affected service, whichever is lower.
11. Customer Responsibilities
You agree to cooperate with reasonable requests for documents, identity verification, payment information, customs details, delivery instructions, and claim support. You agree not to misuse the website, interfere with security, attempt unauthorized access, upload harmful code, submit false information, or use the services for unlawful purposes.
12. Website Content & Intellectual Property
Website text, graphics, layout, logos, icons, software, and other content are owned by Yempa Cargo or its licensors unless stated otherwise. You may not copy, sell, modify, distribute, or exploit website content without permission, except as allowed by law.
13. Third-Party Services
